Parking appeals

If you have received a Penalty Charge Notice and wish to pay it please visit our online parking payments website.

If you have been issued a Penalty Charge Notice within the London Borough of Lewisham and wish to contest it please follow the process below.

How to make informal representation

If the Penalty Charge Notice (PCN) was issued incorrectly, you can make informal representation in writing.

Please ensure your correspondence contains:

  • Penalty Charge Notice number
  • vehicle registration number
  • full name
  • address.

Please note we are unable to make a decision whether or not to cancel a Penalty Charge Notice over the telephone. However, you can contact the Parking Shop if you require any further information.

Formal Representation

Formal Representation can only be accepted 28 days after your Notice to Owner is served. If the Council rejects your formal representation, you can appeal to the independent parking adjudicator at the Parking and Traffic Appeal Service.

The adjudicator is restricted by law to consider appeals only on the grounds listed on the representation form or Your Right to Appeal form.

For legal reasons, it is not possible to appeal to the parking adjudicator unless the owner of the vehicle first makes formal representation to the Council and a Notice of Rejection has been sent.

The decision of the adjudicator is legal and binding on both the Council and the person making the appeal.

Appeals can be decided either in person or by post, depending on your preference.

The Parking and Traffic Appeal Services will advise you of the date and time of your hearing. Please note that the Parking and Traffic Appeal Service arrange all dates and times of hearings.

If the Parking and Traffic Appeal Service uphold your appeal the Penalty Charge Notice has been withdrawn. If the adjudicator refuses your appeal you have 28 days from the date of the adjudicator’s letter to pay the outstanding amount.

If the Penalty Charge Notice is not paid within 28 days of the Parking and Traffic Appeal decision, the Council can issue a Charge Certificate increasing the full Penalty Charge Notice by a further 50%.

Can I pay and appeal?

Once payment is made the case is closed, and your appeal will not be considered.

Can I appeal to the independent adjudicator as soon as I have received a Penalty Charge Notice?

Before an Appeal can be lodged with the Parking Appeals Service you must make formal representations to the Council upon receipt of your Notice to Owner. Once the Council has had the opportunity to consider your representations you will receive either a Notice of Acceptance or a Notice of Rejection. Upon receipt of a Notice of Rejection you can lodge an appeal to the independent adjudicator. (Information on how to lodge an Appeal will be sent together with the Notice of Rejection).

Will the penalty increase if I lose my appeal?

The payment due will be the full payment rate indicated on the Penalty Charge Notice as the 14 day discount period would have elapsed. If you lose your appeal you will be given another 28 days to pay the full payment rate before any further payment increase.

What happens next?

All correspondence will be responded to, however, please note that payment must be received within 14 days from the service date of the Penalty Charge Notice to qualify for the discounted rate.

Full payment must be made before the end of the period of 28 days beginning with the date the Penalty Charge Notice was served. A Notice to Owner will be issued if the Penalty Charge Notice remains unpaid. Please be advised that the registered keeper of the vehicle is liable for the Penalty Charge Notice even if they were not driving the vehicle at the time the Penalty Charge Notice was issued.

Notice to Owner has been received

If the Penalty Charge Notice has not been paid within 28 days and the registered keeper of the vehicle has received the Notice to Owner (NTO), then formal representation can be made.

Formal representation

The Notice to Owner will advise that there is a further 28 days from the date of the Notice to Owner to either:

  1. Pay the full Penalty Charge Notice (not at the reduced rate); or
  2. Make a formal written representation to the Council. The grounds for representation are stated on the representation form sent with the NTO.

On receipt of the formal representation, the Council will carefully consider all the relevant facts relating to your Penalty Charge Notice, and consider any mitigation.  

If your representation is accepted you will be notified that the Penalty Charge Notice has been cancelled. Otherwise, you will be sent a formal Notice of Rejection together with an appeal form to enable you to appeal to the Parking and Traffic Appeal Service or pay the Penalty Charge Notice within 28 days.
