Planning Obligations - Supplementary Planning Document

As part of the emerging Local Development Framework, the Council intends to prepare a Planning Obligations Supplementary Planning Document (SPD) to create greater transparency and openness in the way planning obligations are agreed with developers. The SPD also aims to achieve sustainable development by outlining the contributions that are expected from developers to deal with the negative impacts of their development.

The Planning Obligations SPD will provide additional information on the policies in the development plan and will be a material consideration in determining planning applications within the borough.

It is proposed to include guidance on the following matters within the SPD:
  • Overview of the Councils approach to negotiating planning obligations
  • The types of obligations that may be sought including detailed guidance on affordable housing, local and strategic transport requirements, education, health, community facilities, open space, public realm, employment and training, town centre management and public art.
  • Standard formula for calculating financial obligations
  • Other related matters including monitoring and legal charges, indexation and use of an open book approach.

Work on the SPD is currently scheduled to begin in March 2008. The Council is required under the Statement of Community Involvement to formally consult at the scoping report and draft SPD stages of the process.
